2. THE SWEEPSTAKES GENERALLY. Please read the following Official Rules carefully before deciding whether to submit your entry to the Fender One-of-a-Kind Blacktop Guitar Giveaway ("the Sweepstakes") via this website ("Website"), which is made available to you by Fender Musical Instruments Corporation ("Fender" or "Sponsor"). By entering into the Sweepstakes outlined below, you are entering into an electronic contract with Fender to be bound by these Official Rules governing the Sweepstakes. In addition, you are agreeing to the Terms & Conditions of Use governing use of this website, pursuant to which you make certain representations to Fender and grant Fender certain license rights to use your Sweepstakes entry and other submitted content. 3. DURATION: The Sweepstakes begins on August 11, 2011, 9:00 AM PST, and ends on Tuesday, September 21, at 11:59 PM PST.
4. ELECTRONIC COMMUNICATIONS: By submitting your Sweepstakes entry via the Website, you agree to do business with Sponsor electronically. By agreeing to do business electronically, you (i) consent to the electronic communication and delivery of all documents related to the Website, the Sweepstakes and all other services provided via the Website, (ii) agree that your act of clicking your consent to these Official Rules is a binding form of your electronic signature, which you agree binds you to these Official Rules, (iii) represent that you have Internet access and a valid e-mail address enabling you access to the Website and to receive communications and documents electronically, and (iv) represent that you have a printer or other device to print or otherwise save communications and documents including, without limitation, these Official Rules and that you have, in fact, printed or otherwise saved a copy of these Official Rules for your records. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents, update your contact information, or request a paper copy of these Official Rules at any time by contacting us as set forth below. We will send you a confirmation notice once we have processed your change request.
5. ELIGIBILITY: Employees of Sponsor or any of its subsidiaries, affiliates or agencies, or members of their immediate families, or persons living in same household of each, are not eligible to enter or win. Entrants must be twenty-one (21) years of age or older to participate. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited, taxed, or restricted by law. The Sweepstakes is open to only to legal residents of the United States of America excluding Rhode Island, Alaska and Hawaii.
6. PRIZE: One winner and one (1) companion (“thoe Prize Winner”) will win the following prize (“the Prize”): a customized Fender Blacktop Tele, two (2) concert tickets to Keith Urban concert (“the Concert”) on October 14, 2011 in Chicago; two (2) meet & greet passes prior to the concert; two (2) nights accommodation in one (1) room at hotel of Fender's choosing; two (2) round-trip airline tickets between U.S. city in eligible state to Chicago (airports to be chosen by Fender); The total estimated Prize Value is $2,500 USD. THE FOLLOWING ARE NOT INCLUDED IN THE PRIZE: any transportation other than identified above. All taxes and shipping expenses (if any) arising from the redemption of the Prize are the responsibility of the Prize Winner.
7. ENTRY: Entries should be submitted by visiting fender.com and by filling out our online registration form that includes the entrant's first and last name, zip code, email address, age, and telephone number. Entries must be received by Sponsor, on or before 11:59 p.m. PST, September 21, 2011. Only one (1) entry per person is permitted; online entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of registration. The use of automatic or robotic entry devices is strictly prohibited.
8. DISCLAIMERS: Sponsor assumes no responsibility and is not liable for system errors and failures, mechanical equipment malfunctions, viruses, hacker attacks, faulty transmissions, or other telecommunications malfunctions, and for any typographical or other error in the printing, offering or announcement of the Sweepstakes or the Prize. Sponsor reserves the right, at its sole discretion to cancel, terminate or suspend the Sweepstakes, if the Sweepstakes becomes corrupted in any manner, or if any unauthorized intervention or other cause beyond the control of the Sponsor affects the administration or proper play or conduct of the Sweepstakes, and to select the Winner by random drawing of all eligible entries received prior to the corruption. By entering this Sweepstakes, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor. All entries are the property of Sponsor.
9. WINNER: The grand-prize winner will be selected from among all eligible entries received, via a random drawing held by Sponsor on September 22, 2011. Odds of winning depend upon the total number of eligible entries received. The winner must be approved by Artist Management. The winner and their guest will be subject to a background check which must be successfully passed in order for the fulfillment of the experience to be executed. Artist management reserves the right to refuse fulfillment at their own discretion and Fender will award Grand Prize to the next in line. Fender, Keith Urban and Artist Management will not be responsible for winner's inability to arrive as directed to the determined location for fulfillment of this package. Inappropriate behavior during the fulfillment of the experience may result in the ending of the experience upon disruptive behavior. Fender, Keith Urban and Artist management are not responsible for any upgrades or additional items/services not listed in this description.
The Prize Winner will be notified by Sponsor by e-mail and by phone. At least three (3) attempts will be made to contact winner. Undeliverable e-mail notification or failure to respond to prize notification given by phone by the Winner within 8 hours of receiving such e-mail or phone call will result in forfeiture of the Prize. In the event of such forfeiture, Sponsor will select an alternative Prize Winner via another random drawing from among all eligible entries. The Prize will be awarded to the Prize Winner. The Prize Winner's name will be posted on the Web Site, and also may be requested from Sponsor by sending a SASE to Sponsor at the address below. In the event the Prize Winner is unable to attend the Concert (s)he forfeits the Prize.
10. PERMISSION TO USE NAME/LIKENESS. The Prize Winner, by submitting an entry, grants permission to have his or her name, city, photograph and/or likeness used worldwide in any manner the Sponsor may deem appropriate for advertising, trade and/or promotional purposes without additional compensation or right of review, including without limitation, posting the Prize Winner's name on the web sites (including the fender.com web site and Fender's social media sites), unless prohibited by law.
11. RELEASE OF LIABILITY. Each entrant, by entering the Sweepstakes, and the Prize Winner, by accepting the Prize, releases the Sponsor, and Sponsor's subsidiaries, affiliates, agencies, directors, officers, agents and employees from any and all liability, claims or actions of any kind whatsoever for any damage, loss or injury resulting from or arising out of participation in this Sweepstakes, and, as to the Prize Winner, the acceptance, use, misuse, possession, loss or misdirection of the Prize. The Winner must sign an Affidavit of Eligibility and Liability/Publicity Release prior to receiving the Prize and/or attending the Concert.
12. NOT A U.S. RESIDENT? The Sweepstakes is only available to residents of the United States of America. You may be eligible to participate in other sweepstakes, and we encourage you to check back for updates. We appreciate your understanding.

14. GOVERNING LAW. The Sweepstakes is governed by the laws of the State of Arizona. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Maricopa County, Arizona for the resolution of any disputes.
