Please read the following Official Rules carefully before deciding whether to submit your entry to The Elvis Presley® Fender Kingman™ Giveaway ("the Sweepstakes") via the Websites ("fender.com" or “facebook.com/fender”), which is made available to you by Fender Musical Instrument Corporation ("Fender" or "Sponsor"). In addition, you are agreeing to the Terms & Conditions of Use governing use of this website, pursuant to which you make certain representations to Fender and grant Fender certain license rights to use your Sweepstakes entry and other submitted content. 3. DURATION: The Sweepstakes begins at 12:01 a.m. PST on January 13, 2012 and ends at 11:59 p.m. PST on February 21, 2012.

4. ELECTRONIC COMMUNICATIONS: By submitting your Sweepstakes entry via the Websites, you agree to do business with Fender electronically. By agreeing to do business electronically, you (i) consent to the electronic communication and delivery of all documents related to the Website, the Sweepstakes and all other services provided via the Website, (ii) agree that your act of clicking your consent to these Official Rules is a binding form of your electronic signature, which you agree binds you to these Official Rules, (iii) represent that you have Internet access and a valid e-mail address enabling you access to the Website and to receive communications and documents electronically, and (iv) represent that you have a printer or other device to print or otherwise save communications and documents including, without limitation, these Official Rules and that you have, in fact, printed or otherwise saved a copy of these Official Rules for your records. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents, update your contact information, or request a paper copy of these Official Rules at any time by contacting us as set forth below. We will send you a confirmation notice once we have processed your change request.

5. ELIGIBILITY: Employees of Fender, Sony Music Entertainment, or their respective parent companies, subsidiaries, affiliates or agencies (collectively, “Sweepstakes Entities”), or members of their immediate families, or persons living in same household of each, are not eligible to enter or win. Open only to persons thirteen (13) years of age or older as of the date of entry, who are permanent legal residents of the 50 states of the U.S. and Canada (excluding the province of Quebec) who are physically located and legally residing therein. Entrants under the age of majority are eligible to win provided that the entrant’s parent or legal guardian accepts the prize on his or her behalf. Entrants must have either a valid social security number, a valid U.S. personal tax identification number and/or a Social Insurance number for Canadian residents. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited, taxed, or restricted by law.

6. PRIZE: One grand-prize winner will receive an Elvis Presley Fender Kingman guitar and a CD copy of Elvis Country: Legacy Edition. The MSRP of the grand prize is $599.99 (USD). Twenty (20) second-place finishers will each receive one (1) Secondary Prize: a CD copy of Elvis Country: Legacy Edition. The ARV of the Secondary Prize is $14.88 USD. Prize(s) is(are) nontransferable. All taxes and shipping expenses associated with the redemption of the prize(s) are the responsibility of the winner(s). Customs and import fees are the sole responsibility of any Canadian resident prize winner (as applicable).

7. ENTRY: Entries must be submitted online at fender.com or facebook.com/fender. To enter online at fender.com or facebook.com/fender, participants must provide email, first and last name, date of birth, postal code and phone number. As part of the Sweepstakes entry process on facebook.com/fender, entrants will be required to “Like” the Fender page on Facebook. Only one entry per person is permitted for those entering online at fender.com. For those entering at facebook.com/fender, you will have the opportunity to earn up to twenty five (25) additional entries when your friends/relatives enter the Sweepstakes via the links shown on your Facebook wall or message after you post-to-wall or invite your friends. Limit: one (1) Primary Entry and up to twenty five (25) additional entries per person/email address for the duration of the Sweepstakes Entry Period. For the purposes of these Official Rules, in order to qualify for the additional entries: (i) your friends/relatives must be valid, eligible entrants of the Sweepstakes at the time they are entering this Sweepstakes; and (ii) the name and email address can only be used once during the Sweepstakes Entry Period regardless if he/she receives more than one invite. Failure to include all required information will invalidate the entry. Online entries on fender.com or facebook.com/fender must be received by Sponsor on or before 11:59 p.m. PST, February 21, 2012. Online entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of registration. The use of automatic or robotic entry devices is strictly prohibited.

8. DISCLAIMERS: Sponsor assumes no responsibility and is not liable for entries that are lost, delayed, late, misdirected, illegible, incomplete, and Sponsor assumes no responsibility and is not liable for system errors and failures, mechanical equipment malfunctions, viruses, hacker attacks, faulty transmissions, or other telecommunications malfunctions, and for any typographical or other error in the printing, offering or announcement of the Sweepstakes or the Prize. Sponsor reserves the right, at its sole discretion to cancel, terminate or suspend the Sweepstakes, if the Sweepstakes becomes corrupted in any manner, or if any unauthorized intervention or other cause beyond the control of the Sponsor affects the administration or proper play or conduct of the Sweepstakes, and to select the Winner by random drawing of all eligible entries received prior to the corruption. By entering this Sweepstakes, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor. All entries are the property of Sponsor.

9. WINNERS: One (1) grand-prize winner and twenty (20) second-place winners will be selected from among all eligible entries received, via a random drawing held on or about February 28, 2012 at 11 a.m. PST. Odds of winning depend upon the total number of eligible entries received. The Winners will be notified by Sponsor by e-mail or by phone. Undeliverable e-mail notification or failure to respond to prize notification given by phone by the Winner within seven (7) calendar days of receiving such e-mail or phone call will result in forfeiture of the Prize. In the event of prize forfeiture by a Winner, Sponsor will select an alternative Winner via another random drawing from among all eligible entries. Any entrant who is a Canadian resident and who is selected as a potential winner, must first fulfill special requirements under Canadian laws before being designated Winner, including correctly answering a time-based, mathematical skill-testing question administered by Sponsor (or Sponsor's designated agent) without mechanical or electronic assistance. Failure to comply with such requirements, as determined by Sponsor in its sole discretion, will render entrant ineligible for winning and another entry shall be drawn and the Sponsor shall be released and discharged from any liability or responsibility in this regard. The Prize will be awarded, and the Winner's name will be posted on the fender.com web site. This information may be requested from Sponsor by sending a self-addressed stamped envelope (SASE) to Sponsor at the address below.

10. PERMISSION TO USE NAME/LIKENESS. The Winners, by submitting an entry, grant permission to have his or her name, city, photograph and/or likeness used worldwide in any manner the Sponsor may deem appropriate for advertising, trade and/or promotional purposes without additional compensation or right of review, including without limitation, posting the Winners’ name on the Fender web sites (including the fender.com web site and Fender's social networking sites) unless prohibited by law.

11. RELEASE OF LIABILITY. Each entrant, by entering the Sweepstakes, and the Winners, by accepting the Prize, releases the Sponsor, and Sponsor's subsidiaries, affiliates, agencies, directors, officers, agents and employees from any and all liability, claims or actions of any kind whatsoever for any damage, loss or injury resulting from or arising out of participation in this Sweepstakes, and, as to the Winners, the acceptance, use, misuse, possession, loss or misdirection of the Prize. The Winners must sign an Affidavit of Eligibility and Liability/Publicity Release confirming compliance with these rules and regulations, releasing the Sponsors and their respective directors, officers, employees and agents from all liability and, except where prohibited by law, permitting the Sponsors to use the selected entrant’s name, address (city and province), likeness, voice, written statements and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsors prior to receiving the Prize. If the selected entrant is under the age of majority, the Affidavit of Eligibility and Liability/Publicity Release must be submitted by the selected entrant’s parent or legal guardian.
